Terms of Use
These Terms of Use govern the use of the iOS app Aura Med and the telemedicine services provided by Auramedical Tecnologia da Informação Ltda. By downloading the app, creating an account and using the services, you fully accept these terms.
1. Parties
The parties to this agreement are:
- Provider: Auramedical Tecnologia da Informação Ltda, CNPJ 58.107.486/0001-41, headquartered in São Paulo, SP — Brasil.
- Patient: natural person aged 18 or older, identified via KYC (CPF, ID photo, selfie) in the Aura Med app.
- Physicians: professionals registered with a Brazilian Regional Council of Medicine (CRM), contracted by Aura Med as medical providers. The physician-patient relationship is direct between you and the physician — Aura is responsible for the platform.
2. Definitions
- Telemedicine
- The practice of medicine mediated by technology, per CFM Resolution 2.314/2022.
- Intake
- Structured collection of your medical history completed in the app before the consultation.
- Medical record
- The set of clinical documents about the Patient — intake, consultations, prescriptions, labs, messages — stored digitally on Aura's servers.
- Aura+
- Assistive-AI functionality that supports understanding of lab results and contextualization of data, subject to physician review.
3. Scope
The scope of this agreement is providing the platform aura.med (iOS application) so the Patient can: complete a guided intake, schedule consultations with partner physicians, hold telemedicine video calls, maintain a longitudinal medical record, sync wearable data (Apple HealthKit and Garmin) and use assistive-AI features (Aura+).
4. Account and eligibility
- The Patient must be 18 or older.
- Account creation requires identity verification (KYC) via the Didit partner: official ID photo with CPF, live selfie and biometric match. Aura may reject inconclusive KYC.
- You agree to provide truthful information and keep it updated. Fraudulent accounts are grounds for immediate suspension without refund.
- The account is personal and non-transferable. You are responsible for protecting your credentials (configured Face ID/Touch ID).
5. Products and pricing
Three products contracted independently (no mandatory subscription, no forced bundle):
First consultation — video
R$ 249.90 (one-off). Video mandated by CFM Resolution 2.314/2022 art. 4. Estimated duration: 40 minutes. Includes intake review, initial clinical plan and prescription when applicable. Billed via Stripe (card or Apple Pay).
Re-evaluation — chat
R$ 149.90 (one-off). Available after the first consultation with the same physician. Conducted by asynchronous chat in the app. Initial reply within 48 business hours. Billed via Stripe.
Aura+ — monthly subscription
R$ 39.90/mo. Optional subscription, independent of the consultation. Includes assistive clinical AI (Aura+), active longitudinal follow-up of the medical record between consultations, and replies within 24 business hours. 14-day free trial.
Billed via Apple In-App Purchase (App Store). The subscription appears on your card statement as an Apple line item, auto-renews monthly, and is fully managed by Apple under Settings > Apple ID > Subscriptions. To cancel, change plan, or request a refund, use that path — Aura cannot cancel the subscription on your behalf (Apple rule).
Prices may be adjusted with 30 days' notice via the app. Patients with paid consultations or active subscriptions are not affected by later adjustments until the next billing cycle.
6. CFM 2.314/2022 — telemedicine
Aura Med complies with CFM Resolution 2.314/2022, which regulates the practice of telemedicine in Brazil. Practical consequences:
- • The first consultation must be by video (art. 4).
- • Subsequent re-evaluations may happen by chat (asynchronous counseling).
- • The medical record is digital and retained for 20 years (CFM 1.821/2007).
- • Prescriptions are digitally signed by the physician via ICP-Brasil certificate (rollout in phase with our partners).
- • We do not handle urgent or emergency care. For those cases, call 192 (SAMU).
7. Assistive AI (Aura+)
The Aura+ feature uses a third-party language model (Anthropic Claude, accessed via Aura's authenticated proxy) to support interpretation of lab results and contextualization of your data. Characteristics:
- • Always physician-in-the-loop: the model's output is reviewed by a physician before reaching you.
- • Every interaction is logged auditably (prompt, response, reviewer, timestamp).
- • You may request the history of your Aura+ interactions at any time via the DPO.
- • Your data does not train the third-party model (contractual clause with Anthropic).
- • Aura+ is assistive. It does not diagnose, prescribe, or replace consultation.
8. Payment
Aura Med uses two distinct billing rails depending on the product:
One-off consultations (first consultation + re-evaluation) — Stripe
Payment processed by Stripe (credit card and Apple Pay) at booking. Aura Med does not store your card data — only the token Stripe generates. The Brazilian service invoice (NFS-e) is issued by Aura Med via FocusNFe and available in the app under "Documents" within 5 business days after the consultation.
Aura+ (subscription) — Apple In-App Purchase
The Aura+ subscription is processed exclusively by Apple In-App Purchase (App Store). Aura Med has no access to your card data nor processes the payment — the financial relationship is direct between you and Apple. Renewal is automatic monthly; the charge appears on your statement as an Apple line item. The corresponding tax invoice is issued by Apple per applicable tax legislation for digital services.
We do not currently accept health insurance or insurer reimbursement.
9. Cancellation and refund
The cancellation policy is symmetric and proportional to scheduling impact:
- ≥ 24 hours ahead
- Full refund (100%).
- Between 4h and 24h
- Partial refund (50%).
- < 4 hours
- No refund (the slot can no longer be reallocated).
- Physician cancellation
- Full refund (100%) regardless of timing.
- Patient no-show
- No refund. You may rebook within 7 days with a new payment.
Consultation refunds are made via the same payment method and processed by Stripe within 7 business days. You can track status under "Payments" in the app.
Aura+ subscription cancellation
Because Aura+ is processed by Apple, cancellation is handled exclusively in Settings > Apple ID > Subscriptions on iPhone. You retain Aura+ access through the end of the already-paid cycle and are not charged for following months. Subscription refunds are at Apple's discretion and must be requested via Apple Support. Aura Med has no control over this policy — it's an App Store marketplace rule.
10. Rescheduling
Rescheduling a booked video consultation is allowed up to 4 hours before the original time, within the same physician's availability. After that, the cancellation rules in section 9 apply.
Chat re-evaluations don't require rescheduling (you start when you can).
11. Liability limitations
- No urgent or emergency care. Aura Med is not an urgent-care service. In a medical emergency, call 192 (SAMU, Brazil) or go to the nearest hospital.
- Does not replace mandatory in-person consultation. Some clinical conditions require a physical exam that telemedicine cannot provide. Your physician will advise when this applies.
- Assistive AI. Aura+ is a medical-decision support tool. We follow the physician-in-the-loop principle and maintain auditable logs (section 7). We are not liable for Aura+ use outside the context of medical follow-up.
- Service availability. We target ≥ 99.5% uptime, but do not guarantee uninterrupted availability — scheduled maintenance is announced 48h in advance.
- Liability cap. Except for intentional misconduct or gross negligence, Aura Med's civil liability is capped at the amount paid by the Patient during the 12 months prior to the event.
12. Jurisdiction, changes and acceptance
Jurisdiction: the parties elect the São Paulo/SP court, waiving any other however privileged. In matters involving the Brazilian Consumer Code, the Patient's domicile court prevails.
Governing law: Brazilian law, in particular CDC, LGPD, Marco Civil da Internet and CFM/ANVISA regulations.
Changes: material changes to these Terms are communicated in the app 30 days in advance and require renewed acceptance. If you do not accept, the account is closed with pro-rata refund of paid, unused consultations.
Acceptance: by completing signup in the app, you declare you have read and fully accepted these Terms and the Privacy Policy. Acceptance is recorded with IP, timestamp and document version.
